This regulatory position statement (RPS) does not change your legal obligationrequirement to have an environmental permit when you store or physically treat metal shredder residues that are hazardous waste.
However, the Environment Agency will not normally take enforcement action if you do not comply with this legal requirement when you store or physically treat hazardous metal shredder residues with a permit that does not include the correct waste codes if you meetcomply with the requirements in this this RPS.
This regulatory position does not apply to any other legal requirements.

In ‘conditions’ you must have the correct level of technical competence to cover accepting and physically treating hazardous shredder residues within 12 months of the issue of the permit variation to include 19 10 03* or 19 10 05* (or both). ‘Things to note’ you will have 12 months from permit variation issue to gain the right qualification. Updated to the latest RPS template. This RPS will be reviewed by 31 March 2026.

We have extended the deadline for variation applications to add hazardous shredder residues to 1 April 2024. You need to have the correct level of technical competence to accept and treat hazardous shredder residues by 31 December 2024. We have added a ‘Things to note’ section. You must keep records for 3 years.This RPS will be reviewed by 31 December 2024.
