This regulatory position statement (RPS) does not change your legal requirement to get an environmental permit for a waste operation when you use a back up (auxiliary) flare to burn biogas from exempt anaerobic digestion plants:to:

• inhave an emergency

• duringenvironmental apermit breakdownwhere one if required

• whenregister youan carryactivity outas routineexempt maintenancewhere ofyou anare appliancerequired used to burndo biogasso

However, the Environment Agency will not normally take enforcement action whenif you do thisnot withoutcomply anwith environmentalthese permitlegal forrequirements a waste operation if you complymeet with the requirements in this RPS.

This enforcementregulatory position does not apply to any other legal requirements.
