Guidance

Get a permit to deal with coal or coal mines

Information about getting permission to enter, disturb or change coal mines or coal managed or owned by the MiningCoal Remediation Authority that’s on your property.

You needmust aget permitpermission to enter, disturb or change coal mines or coal managed or owned by the MiningCoal Remediation Authority that’s on your property.

This includes:

  • coal seams under your property

  • coal workings, such as existing mine tunnels

  • mine entrances

You need to get a permit if you want to:

  • cap the mine

  • fill the mine

  • drill boreholes through a coal seam

  • build over or near to the entrance to the mine

You need a mining licence or ‘agreement’ to mine coal or extract gas.

How to apply

Fill in the online application form. You’ll needhave to register first if you do not have an account with the MiningCoal Remediation Authority.

    Water Resources and flood defence consents

    Making changes to a current permit

    IfWe recognise that in some cases, new information arises after a permit has been issued, youwhich canwill applyrequire changes to the permit or approved methods and techniques.     Significant variations

    Minor variations

    A minorsignificant variation is any variation that requires a technical assessment to be done.

    Permitextend extensions

    Multiple activities on onesame permit application

    IfWhere youone applypermit forapplication is made to cover multiple activities on a single site, the application fee payable is the totalaggregate sum of alleach of the proposed activities.

    If multiple phases of work are neededrequired forin relation to a mine entryentry, (forsuch example,as investigation followed by capping),capping youor cangrouting includefollowed by capping, these can be covered on a single application.application Thewith the permit will be issued on a conditional basis, depending on the information available.

    This allows youthe initial phase to startcommence with the initialapplicant phasereturning andto complete the engineering appraisal later.

    Theprocess at a later date. The application fee will be the totalsum of the mine entry investigation and the mine treatment activities.
