This guidance is intended for tenants and landlords who already have a business lease and want to review or end it.
It also covers the procedures for ‘contracting out’. This allows those negotiating a first-time lease – the future landlord and tenant – to agree to exclude security of tenure. When such an agreement is in force, the tenant loses the right to renew the lease, so it is particularly important for soon-to-be tenants to get legal advice on this point.
The guidance also contains information about forms prescribed under the Landlord and Tenant Act 1954, Part 2 (Notices) Regulations 2004, explaining that from 30 July 2026, jurisdiction for certain disputes related to certain telecommunications tenancies under the Landlord and Tenant Act 1954 are conferred on the First-tier Tribunal and the Upper Tribunal.
