This consultation response sets out the Tribunal Procedure Committee’s conclusions on possible changes to the Tribunal Procedure (Upper Tribunal) Rules 2008 in respect of applications for judicial review.

The Tribunal Procedure Committee has already consulted on possible amendments to the costs/expenses rules in the First-tier, Upper and Employment Tribunals.  That consultation, which closed on 29 July 2026, included possible amendments to the costs provisions in the Upper Tribunal Rules to make clear that the Upper Tribunal can award interest on costs.

Consultation description

The Tribunal Procedure Committee is consulting on proposed amendments to the Tribunal Procedure (Upper Tribunal) Rules 2008 relating to immigration judicial review proceedings in the Upper Tribunal (Immigration and Asylum Chamber).

The proposed amendments are intended to clarify aspects of current procedure and, where appropriate, align the approach taken in the Upper Tribunal more closely with that of the Administrative Court in relation to judicial review proceedings. The consultation invites views on whether these changes should be made.
