TheOn government25 intendsApril to2023, laythe regulationsgovernment inlaid Springdraft 2023affirmative regulations to establish a Responsible Actors Scheme (RAS) for residential developers under sections 126-129 of the Building Safety Act 2022.
The RASSubject aims to improve the safetywill andof standardParliament, ofthe buildingsregulations bywill requiringbe thatbrought anyinto memberlaw ofin theSummer 2023.
The Scheme mustwill recognise action taken by responsible developers to identify and remediate,remediate or pay forto theremediate remediation of, life-critical fire safety defects in 11m+ residential buildings they developed or refurbished in England over the past 30 years.years prior to 5 April 2022. To demonstrate that commitment, members of the Scheme will be required to enter into and comply with the terms of the developer remediation contract.
Eligible developers thatwho do not enter into and comply with the terms of the developer remediation contract will not be able to join and remain in the Scheme, and will therefore be prohibited from carrying out major development and gaining building control sign-off.
