Responsible Actors Scheme
GovernmentRegulations has laid draft affirmative regulations to implement the first phase of the Responsible Actors Scheme.Scheme passed into law on 3 July 2023. Eligible developers who do not join the Scheme and comply with theits Scheme conditions will have planning and building control prohibitions imposed on them.

On 253 AprilJuly 2023, the government laid draft affirmative regulations to establish a Responsible Actors Scheme (RAS) for residential developers under sections 126-129 of the Building Safety Act 2022.2022 Subjectpassed tointo thelaw. willThe ofgovernment Parliament,intends theto regulationslaunch willthe beScheme brought into law in Summer 2023.
The Scheme will recognise action taken by responsible developers to identify and remediate or pay to remediate life-critical fire safety defects in 11m+ residential buildings 11 metres or more in height which they developed or refurbished in England overduring the 30 years prior to 5 April 2022. To demonstrate that commitment, members of the Scheme will be required to enter into and comply with the terms of the developer remediation contract.
Eligible developers who do not enter into and comply with the terms of the developer remediation contract will not be able to join and remain in the Scheme, and will therefore be prohibited from carrying out major development and gaining building control sign-off.

The draft regulations laidmade on 253 AprilJuly 2023 supersede the key features of the Scheme that were published on 24 March 2023.
